The Shore Acres Improvement Association owns and maintains the following facilities: The subdivisions of Shore Acres, Adams Point, Weatherly, and various parcels of land in between are all served by the Shore Acres Improvement Association. Membership and facilities of the SAIA are available to their residents and property owners. Weatherly also has its own community association and facilities unique to it. "Shore Acres Estates," although part of the Shore Acres subdivision, has an association for the purposes of regulating its appearance and maintaining the street on which the homes sit. Preemptory is part of the Shore Acres subdivision and has no separate legal existence. The Shore Acres Improvement Association owns and maintains a community beach for all residents and property. It is located at the eastern end of Forest Drive. From Shore Acres Road, turn onto Lake Drive. Go to the end of Lake Drive and turn right (don't make the left before you get to the end of Lake Drive; that goes the wrong way). Go to the end. The community beach is available for the use of all members of the Shore Acres community, irrespective of whether they belong to the Shore Acres Improvement Association. But it is for the exclusive use of the community. No one from outside the community may use the beach unless he or she is a guest. Guests are permitted if accompanied by a Shore Acres resident or property owner. The facilities (picnic tables, grills, and benches) have been provided by the Association for the enjoyment of those using the beach. They are available on a first-come-first-serve basis. The Association reserves the right to pre-empt their use for scheduled social activities. To maintain the usefulness and ambiance of the facility, it is necessary for the Association to enforce the following Beach Restrictions :
The boat ramp is available for the use of all members of the Shore Acres community who acquire a permit. The cost of a boat ramp permit for members of the Shore Acres Improvement Association is $35.00. Residents and property owners may purchase a permit even if they are not members of the SAIA, but at a cost of $80.00. SAIA members who own property that is part of the Lake Placid Waterway Improvement Tax District, and who pay a surcharge on their property taxes that pays for the dredging of the lake and channel, may be issued a boat ramp permit without charge. No one has permission to use the boat ramp unless he or she has obtained a permit from the SAIA. Boat ramp permits are issued for recreational purposes only. No commercial use of the boat ramp is permitted. If a permit holder wishes an agent (e.g., a professional to remove or launch the boat) to use the permit, he should obtain permission from the Board in advance. A family need only purchase one permit regardless of the number of boats it owns or uses. A family is defined as a household, under a single roof, and at a single address. If two residents own a boat jointly, they need only obtain one key between them. A permit holder may obtain an additional key at the price of $5.00 - but only provided that it is not to be shared with another family. A "guest" may use the permit, but only if the permit holder is present during its use. To ensure that Shore Acres residents get the full value of their investment in the boat ramp, to avoid undue hardship on neighbors, and to exclude interlopers from other neighborhoods, the following Boat Ramp Rules must be honored by permit holders: . Keys are not to be lent out or shared under any conditions. . The boat ramp is to be locked after each use, both when putting the boat into the water, and taking it out. . No trailers are to be parked at the beach; boaters must take the trailers back to their home for the time they are out on their boat. . During the time users remove or retrieve their trailers, boats must be secured to the catwalk/pier at the end or to the side away from the ramp so that they are out of the way of others using the ramp. . Boats may be tied up at the pier only while awaiting the arrival or departure of the trailer; no one may dock their boat there. . Users are expected to show courtesy in waiting to use the boat ramp and in staying out of the way of those who are using it; they are also expected to drive slowly along Forest Drive as they approach and leave the beach. . The speed limit on the lake and in the boat channel is 6 mph; boaters should observe this limit until they are beyond the stone jetty. . Payment for the boat ramp permit and use of the key constitutes agreement to abide by these rules; if the terms are accepted by using the key and the rules are not followed, the Association reserves the right to revoke the permit without any refund of fees. The Association has a clubhouse located on Magothy Avenue in Shore Acres. It is equipped with a kitchen and has spacious grounds. It can accommodate 138 people seated for a meeting, or 70 people at tables. The grounds include a parking lot as well as the community's recreation area. Directions to the Clubhouse: Follow Shore Acres Road. Make a right onto Magothy Avenue. The clubhouse is on the right. The clubhouse exists for the benefit of the Shore Acres community. The SAIA uses it for its board and general meetings, as well as for social events and community services such as the dumpsters and flea market. The clubhouse is also available to members, nonmembers, and nonresidents for private use. Please see the Clubhouse Rental page for details. A civic or charitable group may at the Board's discretion be allowed to use the facility for meetings without charge on a space available basis if one of the members belongs to the Association. In the case of a civic or charitable group using the clubhouse for meetings, an Association member must be participating in the activity, and must act as representative for the group in contracting with SAIA for the clubhouse's use. The Association can also rent out its folding metal chairs and tables to members. And it has a ten-by-ten canopy that can be borrowed by members for a small fee. On the clubhouse grounds is a recreation field and playground available to all regardless of membership in the Association. The recreation area at the SAIA clubhouse comprises the basketball court, playground, sand box, benches, picnic tables, and grassy field in between. It is owned and maintained by the Association. . It is open to anyone. But SAIA sets the rules of operation. . The playground and field are open from sunrise to sundown. . Basketball court is open until lights-out at 9:30pm . Children under the age of 9 must be supervised by someone at least 13 years of age. . Loud music or other noise disturbing to neighbors is prohibited. . The Improvement Association reserves the right to remove anyone from the premises for inappropriate or objectionable behavior. . The facilities are available on a first-come-first-served basis, except that the Association may pre-empt their use for Association functions, and the Association may pre-empt use of the basketball court or any other sports-related part of the area for scheduled games. The Association maintains three announcement signs: a large one at the junction of Shore Acres Road and Deep Creek Avenue, and two small ones at the beach and recreation field. Unfortunately, the signs cannot - but for very exceptional circumstances - be made available for private use. They exist for the benefit of the Shore Acres Improvement Association, for SAIA-sponsored events, or events the SAIA wants to advertise. There are five reasons for this restriction. First, we have an obligation to the households nearest the signs to keep them attractive; and that generally means a fairly uniform style and presentation and lack of clutter. Second, we need to exercise control to prevent inappropriate messages from being erected and avoid the appearance of sponsoring or approving of activities advertised. Third, without regulation, announcements may cover up previous announcements, may be left to deteriorate, and may not be removed when the advertised event has occurred. Fourth, in the case of the big sign at the top of the hill, we must guarantee that the announcements on it can be easily read from a passing automobile without the need to stop, slow down, or get close. And fifth, our own announcements require space and take priority over anyone else's use of the sign; even when the sign appears to be empty, it may be scheduled for use within the time period someone else hopes to use it, requiring the removal of their message. There are two exceptions. First, the big sign may provide directions to the clubhouse by someone who is renting the facility. Second, the signs may provide notice of something time-sensitive and critical matter that otherwise cannot get the immediate attention of members of the community such as a lost or found (or stolen) animal, briefcase, purse, etc. These exceptions are subject to the following conditions: . The notice must be posted on behalf of a member of the Association (or in the case of #1, a renter of the clubhouse). Non-members or non-renters may not use the signs, regardless of the reason. . There must be room on the sign; no private notice may cover an SAIA announcement or be placed anywhere else on the sign but the notice board part. . Notices on the big board must be readable from a passing auto. Approximately 250 point type is a required minimum. . The poster must commit to a definite period of time that the notice will stay up, and remove it at the end of that time (and understand that if a scheduled SAIA announcement is going up, the private posting will be removed automatically). . The announcement must be preapproved . This may be done by checking with Communications Committee. Any announcement failing to meet this standard will be removed even if it meets all other standards. In order to be fair to everyone involved, the Association must remove all unauthorized signs or signs violating the conditions above, regardless of who has placed them there or the reason for doing so. Note concerning services from the Association Some of the services and facilities made available to the community by the Association are only for members and/or those who have paid for the privilege. From time to time, an individual may obtain the privilege on the assurance that he or she has paid or will paid the fee or membership dues required. In the event that it turns out that the promised fee or dues is not paid, the family in question is deemed to owe the sum to the Association. Any family owing money to the Association as of the end of the fiscal year is deemed to be in arrears at that time. The Association will not provide the family in arrears any service that is at its discretion to provide until the arrears, plus an additional fee of $20 is paid. |
